This Acceptable Use & Play-for-Fun Policy (the "AUP") is part of the Terms of Service between The Sportsbook ("we") and each Operator ("you"). Capitalised terms, including "Monetary Value" and "Real-Money Gambling", have the meaning given in the Terms of Service. A breach of this AUP is a breach of the Terms of Service.
1.1 This AUP applies to you, your Authorised Users, your contractors, and anyone who uses your Account, your API Keys or your Sportsbook on your behalf. You must make sure they all comply with it.
1.2 This AUP sets minimum rules for use of the Service. It does not describe everything that Applicable Law requires of you in the places where your Players are. Complying with Applicable Law remains your responsibility (Terms of Service, section 6).
1.3 Where this AUP and the Terms of Service differ on what you may do, the stricter rule applies.
2.1 No Player, and nobody else taking part, pays, risks, wins or receives anything of Monetary Value. Your Sportsbook must be a free game played with Tokens that are worthless in both directions: nothing of value goes in to get them, and nothing of value comes out for them. Your Fees to us are payment for software and are not part of the game.
2.2 Sections 3 to 6 explain what this means in practice. Section 12 gives examples.
3.1 Permitted sources. Players may receive Tokens only in ways that involve no payment and no Monetary Value. Examples:(a) an equal starting balance for every Player;(b) periodic free refills, for example a daily refill;(c) free engagement with your community, such as watch time, follows, chat activity or channel points, provided that the number of Tokens a Player receives never depends on whether, or how much, the Player or anyone else has paid (for example, you must not apply any subscriber multiplier or bonus when converting channel points, and you must convert at a rate that ignores it); and(d) free actions unrelated to the outcome of Bets, such as completing a profile or attending a community event that is free to attend.
3.2 Prohibited sources. Players must not be able to obtain Tokens, directly or indirectly, for money or anything of Monetary Value. In particular, Tokens must not be:(a) sold, or offered in exchange for money, crypto-assets or any other payment;(b) bundled with, or granted as a perk of, a paid subscription, membership, tier or pass, including paid or gifted channel subscriptions;(c) granted for donations, tips, bits, super chats or similar paid interactions;(d) granted in proportion to money spent, for example "1 Token for every $1 you spend";(e) granted with the purchase of merchandise, games, in-game items, NFTs or any other product;(f) converted from any points, currency, credits or items that were bought or that have Monetary Value, including loyalty points that can be redeemed for goods, services or discounts;(g) granted in exchange for an entry fee of any kind; or(h) granted for completing offers, surveys, free trials, sign-ups or purchases with third parties (offer walls), or for any action for which a third party pays you per completion, unless we agree in writing.
3.3 Separate Token balance. If you run another points, loyalty or virtual-currency scheme, the Tokens used in your Sportsbook must be a separate balance. It must not be convertible to or from that scheme's points, currency or items, unless those points, currency or items also meet every rule in sections 3 and 4. This applies in particular if you run a loyalty or rewards programme. In Operator-Held Token Balance mode, the balance you connect to the Service must be this separate Token balance (Terms of Service, section 9.3(e)).
3.4 Requests for more Tokens. The Embed may show a button that lets a Player ask your page for more Tokens. Whatever that button opens must comply with this section 3: it must not sell Tokens, show a price, accept any payment, or lead to any page where Tokens, or anything that can be converted into Tokens, can be bought. You must not describe that button, or your own flow, as a deposit, purchase or cashier.
3.5 A free route at all times. Every Player must at all times be able to obtain enough Tokens to keep playing without paying anything, for example through a free periodic refill. You must not make Tokens scarce in a way that encourages anyone to seek them for value.
4.1 No redemption. Tokens, balances, Bets, winnings and rankings must never be redeemed, exchanged, converted, cashed out or used to obtain anything of Monetary Value, by you or by anyone else. This includes:(a) money, e-money or crypto-assets;(b) gift cards, vouchers, store credit, discounts or rebates;(c) goods, merchandise, services, subscriptions (including gifted subscriptions), memberships, tickets or experiences;(d) in-game or virtual items, skins, currencies or points that are sold, can be bought, sold, traded or transferred, or are otherwise available for purchase; and(e) any right to play, or to keep playing, a game or service that is otherwise available only for payment.
4.2 No transfers. Players must not be able to send, gift, sell, trade or lend Tokens or balances to one another or to third parties. Player accounts must not be sold or transferred. Your terms for Players must prohibit these things, and you must act against any secondary market you become aware of.
4.3 No blockchain. Tokens must not be minted, bridged, wrapped or represented on any blockchain or distributed ledger. They must not be issued or described as crypto-assets, NFTs or other transferable digital assets.
4.4 No value by presentation. You must not describe Tokens as having any value, price or exchange rate. You must not use the symbol or code of any fiat currency or crypto-asset, including ISO currency codes and crypto-asset tickers (such as $, US$, R$, €, £, ₿, USD, EUR or BTC), as your Tokens' name or label, or present Tokens in any other way that suggests they are money.
4.5 Negative balances. A balance that goes below zero after a correction is only a record of Tokens and never a debt. You must not ask a Player to pay money or anything of Monetary Value to restore it (Terms of Service, section 8.5).
5.1 Permitted Recognition. "Permitted Recognition" means recognition that has no Monetary Value and cannot be exchanged for anything that has. It must be:(a) free;(b) non-transferable;(c) not sold or otherwise available for purchase, in your community or anywhere else; and(d) not a gateway to anything of Monetary Value.
Examples include a leaderboard position, a title or badge, a chat colour or role, a community role (for example on Discord), non-tradeable cosmetic flair inside your own community, and an on-stream or in-chat mention of the Player's nickname that does not promote the Player's own channel, business, content or links. You may offer Permitted Recognition based on Bets, balances or rankings. You are solely responsible for it, including its legality and presentation in each place where your Players are.
5.2 Prohibited promotions. You must not:(a) award any prize, reward or benefit of Monetary Value by reference to participation in your Sportsbook, or to Bets, balances, winnings, rankings or results;(b) use participation in your Sportsbook, or Bets, balances, winnings, rankings or results, to decide entry to, eligibility for, or the chances of winning in any giveaway, raffle, draw, contest, sweepstakes or other promotion that has a prize of Monetary Value;(c) charge any fee, or require any purchase, to take part in any contest, leaderboard or promotion linked to your Sportsbook; or(d) run any sweepstakes, dual-currency, redeemable-coin or similar model on or around the Service.
5.3 Promotions outside the Service. You may run giveaways and other promotions that have nothing to do with your Sportsbook. They must not be linked in any way to participation in your Sportsbook or to Bets, balances, winnings, rankings or results, and you must not promote them together with your Sportsbook as if they were connected. They are outside the Service and entirely your responsibility. We do not review or approve them.
6.1 You must not use the Service:(a) as, within or together with any Real-Money Gambling product;(b) to advertise, promote, link to or acquire customers for any Real-Money Gambling operator or product. This covers any placement in or around the Embed, in your Sportsbook's name or branding, in maintenance messages, or in promotions linked to it, and includes affiliate links, referral or promo codes, odds boosts, bonus offers and operator branding;(c) to provide or support tips, picks, predictions or advice sold or offered for Real-Money Gambling; or(d) for fantasy sports or prediction contests with prizes of Monetary Value.
6.2 If you or any company in your group offers Real-Money Gambling in any jurisdiction, or acts as a gambling affiliate, tipster service or marketing partner of a gambling operator, you may use the Service only if a separate written agreement signed by us allows a free-to-play use that complies with this AUP and with any rules that apply to free versions of gambling products (Terms of Service, section 5.6). Whatever your business, section 6.1(b) always applies.
7.1 Age. Only people aged 18 or over may play. If higher, the age of majority, or any minimum age that Applicable Law sets where the Player is located for taking part in the Sportsbook or in simulated or real betting, applies instead. You must use age-assurance measures appropriate to your audience and to Applicable Law.
7.2 Not for minors. You must not direct your Sportsbook, or any marketing for it, at minors. You must not use content, characters, language or placements that are likely to appeal particularly to people under 18.
7.3 Responsible play.(a) You must honour a Player's request to stop playing by blocking that Player.(b) You must not target people you know or should reasonably know to be vulnerable.(c) You must not suggest that betting is a way to earn money, solve problems or gain social or financial success.
7.4 Territories. You must not make your Sportsbook available where free-to-play simulated betting, or your particular use of it, is prohibited or needs a licence, authorisation or classification you do not hold. You must also respect any restricted territories we designate (Terms of Service, section 6.4).
8.1 Required disclosures. Before Players first play, and in your terms for Players, you must tell them clearly that:(a) the Sportsbook is for entertainment only;(b) Tokens have no monetary value;(c) Tokens cannot be bought, sold, transferred, redeemed or exchanged for money, prizes or anything of value;(d) no real money can be staked or won;(e) Players must be 18 or older, or older where local law requires; and(f) you, not us, run the Sportsbook and its Tokens.
Annex A contains short model text. Our player notice template, published at https://thesportsbook.app/legal/player-notice, contains a fuller model that meets this section and section 9.2.
8.2 Our notices. You must not hide, cover, remove, alter or contradict the notices we display in the Embed (Terms of Service, section 5.4).
8.3 Neutral words. In your Operator Properties, marketing and communications about your Sportsbook, you must not use words or imagery suggesting that real money or value is involved. For example, do not say "deposit", "withdraw", "cash out", "payout", "cashier", "buy tokens", "real money", "win money", "get paid" or "jackpot", and do not use casino or bookmaker imagery or branding. You may use such words only to state that something is not possible, for example "Tokens cannot be cashed out".
8.4 No false claims. You must not claim or suggest that:(a) your Sportsbook, or the Service, is licensed, regulated or approved by any authority;(b) we endorse, sponsor, have reviewed or have approved your Sportsbook; or(c) your Sportsbook is affiliated with any league, team, athlete, event organiser or data source.
8.5 Advertising and influencer rules. Your marketing must comply with the advertising codes, influencer and branded-content disclosure rules, and platform rules that apply to you.
9.1 You must identify Players only with pseudonymous identifiers. You must not send email addresses, phone numbers, legal names, government identifiers, payment data, precise location, special categories of personal data, or data you know relates to a child. This applies to the Player identifier, the display name, reasons for balance adjustments or blocks, and every other field. Display names may contain only a nickname or username that the Player has chosen or agreed to; you must not fill them from a legal-name field in your records.
9.2 You must have a lawful basis for processing Player Data, inform Players through your own privacy notice, and handle Players' data protection requests. Your privacy notice must say that a technology provider processes their data on your behalf, and must tell them that The Sportsbook, as the provider of the software, also uses some of that data for limited purposes of its own and refer them to section 4.8 of our Privacy Policy at https://thesportsbook.app/legal/privacy. You may, but need not, name The Sportsbook as the provider of the sportsbook software. Section 4.2 of the DPA sets out what the information must contain, and the player notice template meets it.
10.1 You must:(a) use API Keys and the signing secret of your Operator-Held Token Balance endpoint only on your servers and keep them confidential;(b) tell us immediately at support@thesportsbook.app of any compromise; and(c) keep your integration consistent with the Documentation.
10.2 You must not:(a) scrape, crawl, harvest, extract, cache, store, index, redistribute or resell Sports Data, or use it to build or train another product, feed or model;(b) place, or allow, automated or scripted Bets designed to extract data, test odds or exploit delays or errors;(c) circumvent rate limits, Plan limits, monthly active Player caps or security measures, including by rotating Player identifiers or creating multiple Accounts or Sportsbooks;(d) carry out load, stress, vulnerability or penetration testing without our prior written consent (good-faith reports of vulnerabilities to support@thesportsbook.app are welcome);(e) introduce malware, or interfere with or disrupt the Service or other Operators' Sportsbooks;(f) frame, display or open sessions for another Operator's Sportsbook without its permission, or let anyone else frame or display yours (Terms of Service, section 10.4);(g) impersonate us or anyone else, or use our name or marks except for the "Powered by" badge and accurate, factual references; or(h) reverse engineer the Service, except to the extent Applicable Law expressly allows it.
11.1 Operator Content, including your Sportsbook's name, logos, images, maintenance messages and reasons you enter, must not:(a) infringe anyone's intellectual property, privacy or other rights, including the trademarks of leagues, teams or other rights holders;(b) be unlawful, defamatory, hateful, harassing, sexually explicit, violent or discriminatory;(c) contain images of identifiable people or other personal data (uploaded files are publicly accessible);(d) be misleading, or suggest that Tokens have value or that real money is involved; or(e) promote Real-Money Gambling (section 6).
11.2 We may remove or disable Operator Content that we reasonably believe breaches this section.

13.2 We review reports diligently and objectively. We will tell the person reporting what we decided, where we have their contact details.
14.1 We have no general obligation to monitor your use of the Service (Terms of Service, section 16.1). If we become aware of a possible breach, we may, in proportion to its seriousness:(a) ask you for information;(b) warn you;(c) remove or disable content;(d) restrict features, block Players or revoke API Keys;(e) suspend your Sportsbook or Account;(f) terminate the Agreement; and(g) report the matter to competent authorities.

14.3 When we restrict or suspend, we will tell you the reasons unless Applicable Law prohibits it or doing so would compromise an investigation or security. You may reply to support@thesportsbook.app to ask us to reconsider, with any information that shows the breach has been remedied or did not occur.
14.4 Our choice not to act on a breach, or to act in a particular way, is not approval of your use and does not waive our rights.
We may update this AUP under section 25 of the Terms of Service.
You may adapt the wording, but you must keep its substance. Replace the bracketed items.
